The Tea Party groups behind Issue 3 aimed to kill "Obamacare” but they badly misfired. The fate of the Affordable Care Act will be decided by the US Supreme Court, not by ballot initiatives in Ohio or any other state.
A strange quirk means voting to add Issue 3 to the Ohio Constitution will jeopardize countless Ohio laws and cause a litigation nightmare.
Two distinguished Case Western Reserve University law professors have found that Issue 3’s language, is so ambiguous and sloppily written that the amendment would likely ban or prohibit future changes to dozens of state laws that keep Ohio families safe and healthy.
Among the existing Ohio laws, programs and policies likely to be affected by Issue 3 are:
- The Workers’ Compensation System
- COBRA
- Child Support Enforcement Orders
- College and University Student Health Insurance Coverage Requirements
- Mental Health and Developmental Disabilities Tax Levies
- School Immunizations and Disease Tracking (such as smallpox, influenza and HIV)
Ohio taxpayers can expect to foot the bill for lawsuits for years to come. This November vote No on Issue 3.
